ISOXAZOLINE PARASITE PREVENTATIVE — VOLUNTARY GUARANTEE EXCLUSION
This addendum is incorporated into the RSJ Labradors Puppy Reservation & Sales Agreement for the puppy identified below.
FDA-recognized neurological risks
BUYER acknowledges that the FDA has identified potential neurological adverse reactions, including seizures, tremors and ataxia, associated with isoxazoline-class flea/tick drugs. Ingredients include afoxolaner, fluralaner, sarolaner and lotilaner; products include NexGard, Bravecto, Simparica and Credelio and products containing these ingredients. This does not mean that any particular neurological event was caused by a particular drug.
Ever-used condition of voluntary guarantee
BUYER EXPRESSLY AGREES THAT IF THE PUPPY/DOG IS EVER ADMINISTERED A PRODUCT CONTAINING AN ISOXAZOLINE-CLASS INGREDIENT, BREEDER’S ENTIRE VOLUNTARY 24-MONTH HEALTH AND GENETIC GUARANTEE IMMEDIATELY AND PERMANENTLY TERMINATES. THIS APPLIES REGARDLESS OF AGE, NUMBER OF DOSES, VETERINARY PRESCRIPTION OR WHETHER AN ADVERSE REACTION WAS OBSERVED.
After such administration, BREEDER owes no refund, replacement puppy or veterinary reimbursement solely under the voluntary extended guarantee. This exclusion does not restrict any nonwaivable statutory or other legal rights, including rights concerning qualifying conditions present at sale. A court may decline to enforce this broad exclusion for unrelated conditions.
BUYER remains responsible for discussing parasite prevention and individual medical risks with a licensed veterinarian. This agreement does not instruct BUYER to withhold necessary veterinary care.
