FAKC alert- problematic bill that will effect Agriculture and companion animals by redefining a common animal husbandry technique
November 15, 2021
Dear Delegates:
Please review this bill which may be problematic. Your calls and letters are requested.
HB 435 Animal Abuse by Representative Grieco of Miami/SB 420 Animal Abuse by Senator Pizzo of Miami have been filed for the 2022 Session. SB 420 by Pizzo does not appear to present a problem to breeders; however, HB 435 introduced by Michael Grieco, District 113, and part of Miami-Dade, has language which is problematic.
This bill creates a new definition for animal husbandry under F.S. 828.126 Sexual Activity with an Animal. This newly proposed definition of Animal Husbandry is limited to agriculture only.
828.126 Sexual activities involving animals.—
(1) As used in this section, the term:
(a) "Animal husbandry" includes the day-to-day care of, selective breeding of, and raising of livestock that are commonly defined as domesticated animals or animals raised for agricultural purposes that are located on land that is used for bona fide agricultural purposes, as defined in s. 193.461(3)(b).
In 2011 the FAKC worked with the sponsors of the original animal abuse bill to establish an exemption that would protect all breeders, whether for agriculture or domestic purposes who practice animal husbandry and facilitate breeding of their animals. This exemption protects us from being charged with a crime for touching our animals to do AIs, whelping, or progesterone testing, etc.
Currently the exemption in 828.126 is as follows: This section does not apply to accepted animal husbandry practices, conformation judging practices, or accepted veterinary medical practices.
It is important that Representative Grieco understand that the way his bill is written, it could have serious unintended consequences! He will be removing our exemption and putting all domestic and animal breeders in jeopardy.
Write or call and tell the Representatives Aides that Animal Husbandry is not limited to Agriculture, but also to the responsible breeding and exhibiting of companion animals as well as animals in zoos. This type of care should not be confused with any type of perverted or be******ty acts:
