What Happens if a Veterinary Clinic Is Not Compliant with the BAI Certificate?

Veterinary clinics in the Philippines operate under a framework of laws designed to safeguard both animal welfare and public health. One of the key requirements is securing a Certificate of Registration/Animal Welfare Registration from the Bureau of Animal Industry (BAI) before opening and operating a clinic. But what happens if a clinic is found to be non-compliant with this requirement?

The Legal Requirement

Under the Animal Welfare Act (RA 8485 as amended by RA 10631), any facility housing or treating animals—including veterinary clinics, hospitals, laboratories, and shelters—must be duly registered with the BAI. This certificate ensures that facilities meet minimum animal welfare and facility standards before being allowed to operate.

Consequences of Non-Compliance

Inspection and Monitoring

The BAI regularly inspects veterinary clinics. If a facility is found without a valid certificate, it is considered operating illegally.

Inspectors may issue compliance orders or inspection reports detailing deficiencies.

Issuance of Warnings or Notices

A non-compliant clinic may first receive a warning, directing the owner to correct violations within a specific timeframe.

Failure to act on these notices can escalate the case.

Suspension or Cancellation of Operations

Clinics operating without a valid BAI certificate can be ordered to suspend or cease operations until compliance is achieved.

This often involves padlocking of facilities or formal notices of closure.

Administrative and Legal Sanctions

Non-compliance constitutes a violation of the Animal Welfare Act.

Penalties under RA 10631 include:

Fines ranging from ₱30,000 to ₱250,000 depending on the severity of the violation.

Imprisonment of 6 months to 2 years for serious cases, especially if cruelty or neglect is involved.

Reputational Damage

Beyond legal consequences, operating without certification damages a clinic’s credibility.

Clients are increasingly aware of welfare standards, and a clinic found non-compliant risks losing trust within the community.

Securing and maintaining a BAI certificate is not just about avoiding penalties. It is about:

Ensuring humane treatment of animals under a veterinarian’s care.

Protecting clients and the public from substandard facilities.

Upholding the veterinary profession’s integrity by showing adherence to national laws.

How to Stay Compliant

Regularly renew and update your BAI Animal Welfare Registration.

Ensure your clinic meets standards on facility design, sanitation, equipment, and animal handling.

Train your staff on animal welfare laws and best practices.

Be ready for inspections and audits by maintaining documentation and visible compliance.
