The UK has strict laws protecting birds during the nesting season. Under the Wildlife and Countryside Act 1981, it’s illegal to intentionally damage or destroy a bird’s nest while it’s being built or in use.
This means trimming or cutting hedges or trees between March 1st and August 31st can be problematic. The RSPB advises that nesting season lasts throughout this period. The best time for trimming is late winter (February) or early autumn (September to October).
You must not disturb nesting birds, regardless of whether the hedge is on your private land or not, so it’s particularly important to check carefully before cutting any hedge during spring or summer. You must also not cause or permit another person to cut or trim.
Garden maintenance during nesting season requires extra vigilance. Before any cutting, carefully check hedges for signs of active nests, which might include adult birds frequently visiting specific spots, carrying nesting materials, or making alarm calls when you approach the hedge.
Disturbing nesting birds can result in fines up to £5,000 per incident and potential prosecution. The severity of penalties depends on the specific circumstances and impact on wildlife. Report to the police (101) as a wildlife crime. If you can, gather some evidence -
Photographs or video footage of the activity;
Exact location & if possible, the name of the person cutting;
Details of any birds nesting in the hedge.
