Logo #1 (gold) or Logo #2 (black)?

I just saw someone post a similar business whose logo looks VERY similar to the black one. It seems my marketer may have Google logos for ideas and I don't feel right using a logo that is so close so we are sticking with GOLD. Thank you for all your input.
