What is Co-Agency?

CO-AGENCY PRACTICE IN MALAYSIA – WHAT THE STANDARD SAYS

Referencing MEAS Standard 7 by the Board of Valuers, Appraisers, Estate Agents and Property Managers (BOVAEP / LPPEH)

🔍 What is Co-Agency?

Co-Agency refers to a cooperating agreement between a Listing Agency Firm and a Co-Agency Firm (commonly referred to as Listing Agent and Co-Agent), whereby the Co-Agent introduces a prospective buyer or tenant to the property.

This practice is formal, structured, and governed by MEAS Standard 7.

Key Provisions of MEAS – Standard 7: Co-Agency Practice

✅ 7.2.1 – Written Agreement
All Co-Agency arrangements must be agreed in writing before any cooperation begins.

✅ 7.2.2 – Expiry Clause
Every Co-Agency agreement must have a clearly stated expiry date, typically set by the Listing Agent.

✅ 7.2.3 – Non-Solicitation
The Co-Agent is not allowed to solicit or secure the same appointment independently during the agreement period.

✅ 7.2.4 – Earnest Deposit Handling
Earnest deposit may be collected by either party but must be held by the client-appointed Stakeholder as stated in writing. The Listing Agent’s rights must be respected.

✅ 7.2.5 – Fee Sharing Ratio
By default, the fee is split 50:50 between Listing Agent and Co-Agent unless agreed otherwise in writing.

✅ 7.2.6 – Aborted Transactions
For aborted deals, the standard abortive fee split is:

• 50% to Client
• 25% to Listing Agent
• 25% to Co-Agent

(Unless otherwise agreed in writing.)

✅ 7.2.8 – Disclosure Obligations
Details such as total fee, earnest deposit, and mode of payment must be disclosed by the Listing Agent to the Co-Agent at the start of the arrangement.

📌 Professional Conduct Under 7.3:

Listing Firm Responsibilities (7.3.1):
• Must manage all viewings and communications
• Ensure prompt payment of Co-Agent’s fees
• Keep Co-Agent informed of progress
• Avoid contacting Co-Agent’s prospects directly

Co-Agency Firm Responsibilities (7.3.2):
• Must channel all dealings through Listing Agent
• Cannot advertise the property or install signage unless permitted
• Cannot contact the Listing Agent’s client directly
• Not entitled to fee if buyer is related or linked, and not disclosed

Earnest Deposit Handling (7.3.3):
• Must be remitted to the authorized party as instructed by the client
• Treated as part of professional fee and split accordingly

Why It Matters ?

Understanding and adhering to MEAS Standard 7 ensures professional conduct, protects agency relationships, and upholds legal compliance in all Co-Agency engagements.

Every registered practitioner should be fully familiar with these standards to avoid disputes and ensure fair, ethical collaboration.
